Assault & Domestic Violence Defence

Assault · Domestic Assault · Intimate Partner Violence · Uttering Threats · Mischief

Assault and domestic violence charges are taken seriously in Canada. Once police are called, Crown counsel typically proceeds with the prosecution regardless of whether the complainant wishes to withdraw the complaint. Zi Wang focuses on assault defence — examining the evidence, witness credibility, and procedural compliance.

Common assault-related charges

Simple assault

In Canada, assault does not require physical contact — intentionally applying force or threatening to apply force imminently is sufficient. A push, a threatening gesture, or blocking someone's path can result in an arrest.

Domestic assault / intimate partner violence (IPV)

Assault occurring between intimate partners or family members. Canadian police operate under mandatory charging policies — once called, officers typically must lay charges even if the complainant does not want them to.

Assault with a weapon

Using a weapon or an object used as a weapon during an assault. A more serious charge carrying heavier potential penalties.

Uttering threats

Threatening to cause death or bodily harm to a person. The threat does not need to be carried out — the offence is the communication of the threat itself.

Mischief

Wilfully damaging or interfering with property. In domestic situations, mischief charges often accompany assault charges.

Defence considerations

The defence approach in an assault case depends heavily on the specific facts. Zi Wang carefully examines:

—The credibility and reliability of the complainant's account
—Whether self-defence or defence of another person applies
—Independent witnesses or surveillance footage
—Whether police followed proper procedures
—Charter rights issues
—Whether a peace bond is an appropriate resolution
—Whether charges can be negotiated for withdrawal
—Immigration consequences of a conviction
